A 22nd Judicial District judge ruled Thursday that a Dolores man is no longer required to register as a sex offender.

Dustin Ray Wall, 30, pleaded guilty in June 2014 to sexual assault and third-degree assault. He entered into a deferred sentence on the sexual assault charge and was sentenced to 90 days in jail for the third-degree assault charge.

By August 2018, Wall had completed the terms of the deferred sentence, the plea was withdrawn, and the sexual assault count was dismissed. More recently, Wall filed a petition to discontinue his sex offender registration, which 22nd Judicial District Chief Judge Douglas S. Walker granted on Thursday.

The charges stemmed from an April 23, 2014, arrest. A 36-year-old victim didn’t consent when attacked at a Dolores hotel, according to court records. Wall was originally charged with two counts of sexual assault, two counts of unlawful sexual contact and one count of theft, but the district attorney dismissed all five of those charges in October 2014 and rescinded the sexual violent predator finding. The district attorney, however, filed an amended complaint in 2014, charging Wall with sexual assault and third-degree assault.

On the deferred sentence for sexual assault, Wall was required to complete sex offense treatment, complete substance abuse evaluation, submit drug and alcohol tests, submit DNA and register as a sex offender.

The sexual assault charge was dismissed, but the guilty plea for third-degree assault still stands. Walker in 2014 sentenced Wall to 90 days in jail. Wall had already been in jail for 106 days at that point and was given credit for time served.
