Three sentenced in DUI cases in Montezuma County court

County Court Judge JenniLynn Lawrence on Monday sentenced Lloyd Lobato to 150 days in jail in connection with a fourth DUI conviction.

Defense attorney Alex Gunning requested home detention for Labato, saying that he is receiving treatment in New Mexico and wouldn’t have access to treatment in jail.

Lawrence declined home detention because Lobato wasn’t a resident of Montezuma County.

Lawrence said she might resentence Lobato is he becomes eligible for home detention before reporting to jail later this month.

Lawrence gave Lobato credit for 64 days served in jail. He also will be required to complete two years of probation and 120 hours of public service.

Two others sentenced

Matthew John was sentenced Monday to 90 days in jail but was given credit for 111 days served on another case. The sentence was in connection with a third alcohol-related driving conviction, and will be served concurrent with his sentence in the other case.

Lawrence sentenced Andrew Abeyta to a 60-day work release sentence followed by a 30-day home detention sentence in connection with an alcohol-related driving offense.

Severn Black was set to be sentenced Monday for a DUI offense, but his sentencing was reset to Jan. 31. Desmond Dan also was set to be sentenced for a DUI, but he withdrew his plea and a trial was set for March 30.

In Montezuma District Court on Tuesday, 16-year-old Jessica Tryban was sentenced to 18 months in the department of youth corrections in connection with felony menacing and aggravated vehicle theft charges.
