Fabine Scott, 31, was found dead in his home June 11 in Shiprock, New Mexico. Shiprock Police Department declined to comment on the death, claiming it was an active investigation.

Scott was accused of inappropriately touching two 10-year-old girls at the rec center on June 1.

An arrest warrant was issued by 6th Judicial District Judge Suzanne Carlson on June 3 on two counts of unlawful sexual assault on a child.

The Durango Police Department is dropping the sexual assault investigation because the suspect is deceased, said Cmdr. Jacob Dunlap.

According to an arrest affidavit, two girls were walking around in the lazy river pool of the rec center.

Scott allegedly followed the girls and grabbed their buttocks on four separate occasions.

Durango Police called Scott at his phone number and Scott denied having touched anyone inappropriately.

He told police he lived out of his car in Cortez and had no fixed address. Three attempts to reach Scott were made before the arrest warrant was issued.

Scott had a history of previous offenses, including assault, child abuse, distribution of drugs, a DUI and resisting arrest.

He had no history of sexual assault.
