Cody Mallett pleaded not guilty Tuesday in Montezuma County Court to charges stemming from a May 2024 incident in which he allegedly crashed his vehicle into a brick retaining wall at Shiloh’s Steakhouse while under the influence of drugs.
Mallett, who is out on bond, will next face a pretrial readiness conference on Tuesday, Nov. 11 at 3 p.m. The jury trial’s first day will be Wednesday, Nov. 19 at 3 p.m., and the second on Thursday, Nov. 20 at 8:30 a.m. in Judge Ian MacLaren’s courtroom.
His trial was originally set for the end of June.
On May 9, 2024, just before 3 p.m., police responded to a crash in the parking lot of Shiloh’s Steakhouse at 5 S. Veach St. Several bystanders were gathered around two heavily damaged vehicles, one of which had reportedly smashed into the restaurant’s brick retaining wall.
Mallett, driving a white Nissan from Arizona, was arrested on suspicion driving under the influence of drugs. According to police, he was driving west in the 2000 block of East Main Street when he struck the driver’s side of a black Chevy. His vehicle then veered off the south side of the road, went airborne through the LivWell Marijuana Dispensary’s lot, crossed the dispensary’s driveway and continued into Shiloh’s parking lot.
Mallett’s car hit the access ramp at Shiloh’s, went airborne again, narrowly missing pedestrians Kirby and Jodi Case, and collided with their black Nissan, a Chrysler and a Jeep Grand Cherokee before slamming into the brick wall.
Mallett told officer Karan Sharp he “passed out” while driving and woke to find himself in the wreckage. A search of his vehicle revealed open containers of marijuana and alcohol scattered inside.
Mallett was cited on suspicion of driving under the influence of drugs, reckless driving and possessing open alcohol and marijuana containers in a vehicle.
Repairs for the wall began on Oct. 21, 2024, and were completed in mid-December.
