Man convicted of domestic violence assault faces more criminal charges

Jury hands down guilty plea; new case is pending

A Cortez man convicted Sept. 24 of assault in the act of domestic violence now faces new criminal charges after allegedly assaulting the same victim.

Harry Lee Bylilly, 48, was arrested Jan. 5 for suspicion of beating up his girlfriend at her residence in the Happy Valley Trailer Park on East Seventh Street, according to the Cortez Police Department arrest affidavit.

The victim suffered facial and back injuries and fled to a friend’s house on Ash Street to call 911.

Bylilly was arrested that night and charged for third-degree assault and domestic violence. Upon his arrest, Bylilly showed a blood alcohol level of 0.4, according to the police report.

Bylilly pleaded not guilty. At a trial in the Montezuma Combined Courthouse, a jury convicted him of third-degree assault in the act of domestic violence.

The sentence range includes the possibility of up to two years in jail. Sentencing is set for Nov. 1 at 3 p.m. by Judge JenniLynn Lawrence.

On March 11, Bylilly was arrested again just after midnight at the same residence for suspicion of assault and domestic violence against the same victim, according to court and police reports.

Upon his arrest, he allegedly had a blood alcohol content of 0.243, the report shows. He remains in custody at the Montezuma County Detention Center.

According to Cortez police reports, on the evening of March 10, the victim suffered facial wounds, including a swollen-closed eye, and leg bruises. She was taken to Southwest Memorial Hospital.

According to a physician’s injury report, the victim sustained serious bodily injury.

The 22nd Judicial District Attorney’s Office has filed charges including second-degree assault-domestic violence, a Class 4 felony. Other charges include violating a protection order and bond conditions, harassment and crime of violence.

Bylilly has pleaded not guilty. His case is set for a jury trial Oct. 11 in 22nd Judicial District Court.
