Man convicted and sentenced again for domestic violence

Aggravated circumstances leads to 6 years in prison

A Cortez man who pleaded guilty to beating up his girlfriend a second time was sentenced again to the maximum sentence in Montezuma County Court.

Harry Lee Bylilly, 48, pleaded guilty Nov. 17 to an amended count of menacing as an act of domestic violence, a Class 5 felony, said Assistant District Attorney Will Furse.

The courts found aggravating circumstances, which led to Chief Judge Doug Walker handing down the maximum sentence of six years in the Department of Corrections.

A Class 5 felony without aggravated circumstances has a presumptive range of one to three years in jail.

According to court records, Bylilly assaulted his girlfriend between March 9 and March 10 at her residence in the Happy Valley Trailer Park on East Seventh Street. He was arrested March 11, and had a blood alcohol content of 0.243, according to police reports.

The victim was injured from the attack and required hospitalization. Injuries included damage to her eye.

It was Bylilly’s second conviction for domestic violence against the same person.

On Sept. 24, a jury convicted him of third-degree assault in the act of domestic violence that occurred on Jan. 5 at the victim’s residence. Bylilly showed a blood alcohol level of 0.4, according to the police report.

Montezuma County Judge JenniLynn Lawrence handed down the maximum sentence of two years in the Department of Corrections. The two prison sentences will run concurrently.
