Warrant issued for Cody Mallett after failure to appear in Shiloh’s wall crash case

A warrant has been issued for the arrest of Cody Mallett, who failed to appear at a pretrial readiness conference in U.S. District Court for the 22nd Judicial District on Tuesday, according to Assistant District Attorney Justin Pierce. Mallett, an Arizona resident, allegedly crashed into the brick wall of Shiloh’s Steakhouse in May 2024. He was arrested on suspicion of drug-impaired driving.

His personal recognizance bond was revoked, and a $1,500 cash or surety bond was set.

His trial is scheduled for 3 p.m. Wednesday, Nov. 19, and 8:30 a.m. Thursday, Nov. 20, in District Court with Judge Ian MacLaren presiding. It was originally set for June.

Cortez police officer Kadan Sharp arrived just before 3 p.m. on May 9, 2024, to find Mallett’s vehicle had caused significant damage to other vehicles and the retaining wall in the Shiloh’s Steakhouse parking lot.

Mallett told police he was driving westbound in the 2000 block of East Main Street when he collided with the driver’s side of another vehicle. He lost control, went off the south side of the road, became airborne through the LivWell Marijuana Dispensary, jumped the dispensary’s driveway and continued into the Shiloh’s parking lot.

The vehicle struck the restaurant’s access ramp, went airborne again and barely missed Kirby and Jodi Case before hitting their vehicle and two other vehicles in the parking lot. It finally stopped after colliding with the brick retaining wall on the west side of the building.

Mallett told Sharp he passed out while driving and awoke to find he had crashed into the wall.

According to police reports, officers found open marijuana and alcohol containers throughout the vehicle. Mallett consented to a blood test at Southwest Memorial Hospital and was cited with drug-impaired driving, reckless driving, and possessing open containers of alcohol and marijuana in a motor vehicle.

Repairs to the damaged wall began in October 2024 and were completed by year’s end.
